Texas Raises Child Support Cap Effective September 1, 2025
Beginning September 1, 2025, Texas will increase the maximum monthly net income amount used to calculate guideline child support. This is an important change for parents involved in child support cases, as it directly impacts the maximum amount of guideline support that may be ordered under the guidelines, which are considered in the best interest of the child.
What’s Changing?
Currently, child support calculations under the guidelines are capped at a maximum monthly net income of $9,200. For example, for one child, the maximum guideline support obligation is $1,840 per month (20% of $9,200).
Starting September 1, 2025, the cap will rise to $11,700 in monthly net income. For one child, the new maximum guideline support obligation will be $2,340 per month (20% of $11,700). This represents a $500 per month increase for high income earners under the guidelines.
Who Does This Affect?
-
If the paying parent earns more than $11,700/month, the new higher cap applies.
-
This change applies to all cases finalized after September 1, 2025, even if the case was filed before that date. This change will also apply to modifications of prior orders finalized after September 1, 2025.
-
If the paying parent (obligor) earns less than $11,700/month, the calculation remains the same:
-
20% of net income for one child
-
25% for two children
-
30% for three children, and so on, up to the statutory maximum.
-
Why the Change?
Texas periodically reviews the child support guidelines to account for changes in the cost of living and inflation. Raising the cap ensures that children receive financial support that more accurately reflects today’s economic realities when one parent has a higher income.
What Should Parents Do Now?
If you have a pending child support case—or if you are considering modifying an existing order—it is important to understand how this change may affect your situation. Higher earners may face increased obligations, while parents receiving support may be entitled to additional funds for their child’s needs.
